These Terms of Service ("Terms") govern your access to and use of the website located at temperandforge.com (the "Site"), operated by Temper And Forge, LLC ("Temper And Forge," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

Temper And Forge, LLC is a digital agency delivering design, development, marketing, and strategy services. Our headquarters is located at 8907 Roosevelt Way NE, Seattle, WA 98115, with an additional office at 50 Milk Street, 16th Floor, Boston, MA. You can reach us at hello@temperandforge.com.

You may use the Site for lawful purposes only. You agree not to:

You may view, download, and print pages from the Site for your own personal, non-commercial reference. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any Site content without our prior written consent. "Temper And Forge" and the T-F marks may not be used without our written permission.

Work samples, case studies, and client names shown on the Site are the property of their respective owners and appear with permission. Nothing on the Site grants you any right to use them.

The Site describes our services, but browsing the Site does not create a client relationship. All client engagements are governed by a separate written agreement between Temper And Forge, LLC and the client, including scope, fees, deliverables, and ownership of work product. If there is any conflict between these Terms and a signed client agreement, the client agreement controls for that engagement.

Information on the Site, including descriptions of services, processes, and outcomes, is provided for general information and does not constitute a proposal, quote, or guarantee of results.

If you contact us through the Site, by email, or through a form, you represent that the information you provide is accurate and that you have the right to share it. Ideas, feedback, or suggestions you send us about our business or the Site may be used by us without restriction or compensation, except as covered by a separate written agreement or applicable privacy law.

The Site may link to third-party websites, platforms, and profiles (for example, LinkedIn, Clutch, or platform vendors we work with). We do not control these third parties and are not responsible for their content, policies, or practices. Linking does not imply endorsement.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

TO THE FULLEST EXTENT PERMITTED BY LAW, TEMPER AND FORGE, LLC AND ITS MEMBERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). LIABILITY ARISING UNDER A SIGNED CLIENT AGREEMENT IS GOVERNED BY THAT AGREEMENT, NOT THESE TERMS.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

You agree to indemnify and hold harmless Temper And Forge, LLC and its members, employees, and contractors from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site in violation of these Terms or applicable law.

Our collection and use of personal information through the Site is described in our Privacy Policy. By using the Site, you acknowledge the practices described there.

We may update these Terms from time to time. The effective date at the top of this page reflects the most recent revision. Changes take effect when posted, and your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-law rules. Any dispute arising out of these Terms or your use of the Site will be brought exclusively in the state or federal courts located in King County, Washington, and you consent to the jurisdiction of those courts.

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
